Terms of Use

These Terms of Use ("Terms") govern access to and use of the FHQ platform, available at fhq.lovable.app (the "Service"), published by Cédric Marrouat, an entrepreneur established in French Polynesia ("FHQ", "we").

By creating an account or using the Service, the user ("you") acknowledges having read, understood, and unconditionally accepted these Terms. The financial terms of the subscription are governed by a separate document, the Terms of Sale ("ToS"), which together with these Terms and the Privacy Policy constitute the entire agreement between the parties.

FHQ is a web analytics platform for the franchise mode of the Madden NFL video game. It allows users to import their data via the EA Companion App and access advanced analysis tools. The Service is provided as SaaS, accessible online, with no local installation required.

The Service is exclusively reserved for persons aged at least eighteen (18) years, or who have reached the legal age of majority in their country of residence if that age is higher. The Service is not intended for minors: no registration by a person under 18 is permitted, including with the consent of a legal representative.

By creating an account, you represent and warrant that you have full legal capacity to be bound by these Terms. If FHQ learns that an account was created by a minor, FHQ reserves the right to delete it immediately.

Creating an account requires a valid email address and a password meeting the minimum security requirements displayed at sign-up. Authentication can also be performed via Google.

You agree to provide accurate information and keep it up to date. You are solely responsible for the confidentiality of your credentials and for all activity carried out from your account; any action taken from your account is deemed to have been taken by you. Any suspicious or unauthorized use must be reported without delay to marrouatcedric@gmail.com. FHQ disclaims all liability for any loss, theft, or fraudulent use of the account resulting from your negligence in protecting your access.

You agree not to:

• attempt to access other users' data;
• circumvent the technical or commercial limits of the Service (rate-limiting, quotas, plans);
• use automated systems (bots, scrapers) without prior authorization, or mass-extract data from the Service;
• use the Service for illegal, fraudulent, or harmful purposes;
• resell or redistribute access to the Service;
• intentionally disrupt or overload the platform or its infrastructure;
• exploit the Service to facilitate cheating or match-fixing within the game.

The source code, interface, design, logos, databases, and all elements comprising FHQ are the exclusive property of Cédric Marrouat and are protected by applicable law. Any unauthorized reproduction, modification, extraction, or exploitation of the Service is strictly prohibited and may result in legal action.

Data imported by you from the EA Companion App remains your property. FHQ only benefits from a limited, non-exclusive license strictly necessary for the provision of the Service (storage, processing, display to the user). You may delete your franchises and all associated data from your personal area at any time.

FHQ is an independent project that is neither affiliated with, sponsored by, nor endorsed by Electronic Arts Inc. ("EA"), the NFL, the NFLPA, or any other entity holding rights related to Madden NFL. Madden NFL, EA SPORTS, and associated trademarks remain the exclusive property of their respective holders.

Any synchronization or import of data from EA's services is done entirely at your own risk. FHQ does not store your EA account credentials. FHQ shall not be held liable if EA decides to restrict, suspend, or ban your account due to the use of third-party tools, nor for any unavailability of game data, which depends exclusively on EA's servers and policies.

The Service relies on third-party services, including Google (authentication) and Paddle (payments).

Regarding payments, Paddle acts as Merchant of Record: Paddle is the legal seller with respect to the end user for all transactions, issues invoices, and manages the collection of applicable taxes (VAT, sales tax, etc.) in accordance with its own terms and conditions. The applicable billing and refund terms are set out in the Terms of Sale and Paddle's conditions.

Use of these third-party services is subject to their own terms of use, over which FHQ has no control.

FHQ collects and processes only the data strictly necessary for the provision of the Service, in compliance with applicable data protection regulations. Given the international nature of the Service, this includes in particular:

• the regulations in force in French Polynesia;
• for users residing in the European Union, the General Data Protection Regulation (GDPR);
• for users residing in the United States, the applicable state laws (in particular the California Consumer Privacy Act / California Privacy Rights Act, as amended).

You have the right to access, rectify, erase, and port your data, exercisable at any time by email at marrouatcedric@gmail.com. Detailed processing terms are set out in our Privacy Policy, which supplements these Terms.

FHQ reserves the right to suspend or close any account in the event of a breach of these Terms, without notice or compensation. You may delete your account at any time from your personal area. The financial consequences of termination (renewal, refund, withdrawal) are governed by the Terms of Sale.

The Service is provided "as is" and "as available", without any express or implied warranty, including as to the absence of errors, bugs, interruptions, or fitness for a particular purpose, to the extent permitted by applicable law. FHQ is only bound by a best-efforts obligation and does not guarantee the permanent retention of league data, which may depend on third-party servers.

FHQ shall not be liable for service interruptions, data loss, or decisions made by the user based on the analyses provided. To the extent permitted by applicable law, FHQ's total liability, on any basis, is limited to the amount actually paid by the user for the Service in the twelve (12) months preceding the event giving rise to the claim. FHQ shall under no circumstances be liable for indirect damages, loss of time, or financial losses.

You agree to indemnify, defend, and hold harmless FHQ (as well as its publisher and partners) from and against any claim, demand, loss, or damage (including reasonable defense costs and attorneys' fees) brought by a third party and arising from your breach of these Terms, your fraudulent or unlawful use of the Service, or your violation of any third-party rights.

FHQ reserves the right to modify these Terms at any time, in particular to adapt them to technical or legal developments. The version in force is the one published on this page. In the event of a material modification, users will be informed by email and/or by notification within the Service. Continued use of the Service after the new Terms come into force constitutes acceptance.

FHQ shall not be liable for any delay or failure to perform its obligations resulting from an event beyond its reasonable control, including: natural disaster, armed conflict, failure of telecommunications networks, breakdown or unavailability of hosting infrastructure, a decision by a third party over which FHQ has no control (in particular the restriction or removal of an API or service by Electronic Arts), or any governmental or regulatory act.

In the event of such an occurrence, FHQ undertakes to inform users as soon as possible and to take all reasonable steps to limit its effects. If the force majeure event persists beyond thirty (30) days, either party may terminate the contract without compensation, in accordance with the terms of the Terms of Sale.

If any provision of these Terms is found to be illegal, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from the remaining clauses and shall not in any way affect the validity or enforceability of the remaining provisions.

These Terms, together with the Terms of Sale and the Privacy Policy, constitute the entire agreement between you and FHQ with respect to the use of the Service and supersede all prior agreements or communications. In the event of conflict, the Terms of Sale prevail on commercial and payment matters.

These Terms are governed by the law applicable in French Polynesia. Failing amicable resolution, any dispute relating to their interpretation, performance, or termination shall fall under the exclusive jurisdiction of the courts of Papeete.

However, where the user is acting as a consumer, no provision hereof shall deprive them of the mandatory protections afforded by the law of their country of habitual residence; such protections remain applicable notwithstanding the governing law and jurisdiction clause above.

The French version of these Terms shall prevail. Any translation is provided for informational purposes only.
