These Terms of Sale govern any subscription order for the FHQ service placed via fhq.lovable.app.
Preamble and scope
These Terms of Sale ("ToS") govern any subscription order for the FHQ service placed via fhq.lovable.app (the "Service"). They supplement the Terms of Use (ToU) and the Privacy Policy, with which they form the entire agreement between the parties.
By placing an order, the customer, who must be at least 18 years old (the "Customer"), acknowledges having read and unconditionally accepted these ToS as well as the applicable Paddle terms (see Article 3).
Article 1 — Seller identification
The Service is published by Cédric Marrouat, an entrepreneur established in French Polynesia ("FHQ", "the Seller").

Orders are processed through Paddle, acting as Merchant of Record (see Article 3).
Article 2 — Purpose
These ToS define the conditions under which the Seller provides paid access to the Service.
The Service offers analysis tools for the Madden NFL franchise mode (cap intelligence, scouting, trade calculator, war room, and other features described on the site), accessible online by subscription.
Article 3 — Paddle's role (Merchant of Record)
The Seller uses Paddle (Paddle and its affiliated entities) as an authorized reseller and Merchant of Record (MoR).
In this capacity, Paddle is the official seller vis-à-vis the Customer for any subscription order. Paddle is responsible for:
- collecting and processing payments;
- issuing invoices;
- collecting and remitting applicable taxes (VAT, sales tax, etc.) based on the Customer's country of residence;
- first-level handling of billing and refund requests.
Any order is therefore governed jointly by these ToS and by Paddle's general terms (Paddle Checkout / Buyer Terms), which the Customer accepts at the time of payment. In the event of a conflict strictly relating to payment, invoicing, taxes, or refunds, Paddle's terms prevail. For all other matters (Service description, use, liability, etc.), these ToS and the ToU apply.
Article 4 — Pricing, taxes, and plans
The Service is offered as annual subscriptions billed in US dollars (USD):
- Starter — essential features;
- Pro — advanced analytics and trade calculator;
- Elite — full command center access.
Current prices are those displayed on the pricing page (fhq.lovable.app/#pricing) at the time of the order. Applicable taxes (VAT, sales tax, etc.) are calculated and added by Paddle at checkout, based on the Customer's country of residence.
The Seller reserves the right to change prices at any time. Current subscriptions are billed at the rate applicable at the time of subscription until their next renewal. Any price change applicable to a renewal is communicated to the Customer in advance, giving them the opportunity to cancel before the due date.
Article 5 — Order and contract formation
Orders are placed online: account creation, plan selection, then payment via Paddle's secure interface. The contract is formed upon payment confirmation by Paddle. An order confirmation and invoice are then sent to the Customer by Paddle.
The subscription nature of the order, its amount, and its automatic renewal are clearly presented to the Customer before payment is confirmed.
Article 6 — Payment
Payments are processed by Paddle using the methods available at the time of the order (credit card, primarily). No banking data is collected or retained by FHQ.
If a renewal payment fails, access to the Service may be suspended until the situation is resolved, without releasing the Customer from amounts owed for the committed period.
Article 7 — Duration, automatic renewal, and cancellation
Subscriptions are entered into for the duration chosen at the time of the order and automatically renewed on their due date for an identical duration, unless the Customer cancels before that date.
The Customer is expressly informed of this automatic renewal at the time of the order. They may cancel their subscription at any time, without charge, from the "Billing" page of their personal area or via the management interface provided by Paddle. Renewal reminders may be sent by Paddle.
Cancellation takes effect at the end of the current period: the Customer retains access to the Service until that date. The applicable refund terms are set out in Articles 8 and 9.
Article 8 — Refund and right of withdrawal (14 days)
The Seller applies a refund policy aligned with that of Paddle, Merchant of Record (Article 3).
Any Customer may request a full refund of their subscription within fourteen (14) days from:
- the initial subscription date; and
- the date of each subscription renewal.
Consumer customers residing in a jurisdiction that grants them a statutory right of withdrawal (in particular the European Union and the European Economic Area) exercise this right under the applicable regulations, without having to justify their decision. For other Customers, this 14-day guarantee constitutes a commercial commitment by the Seller.
Refund requests are processed by Paddle. The Customer may submit them to marrouatcedric@gmail.com or directly to Paddle via paddle.net. Where a refund is granted, it is processed within fourteen (14) days.
In accordance with Paddle's terms, a refund may also be granted, irrespective of the above deadline, in cases of manifest error, fraud, payment dispute (chargeback), failure to provide the Service, or where required by law.
Article 9 — No refund beyond the 14-day period
Outside the fourteen (14)-day period provided for in Article 8, and subject to any mandatory provision of the law applicable to the Customer or a decision by Paddle, payments made are final and non-refundable, including for partially used subscription periods.
Cancelling a subscription ends its future renewal but does not give rise, beyond the 14-day period, to a refund for the current period already in progress.
Article 10 — Warranties and liability
The Seller undertakes to provide the Service diligently and in accordance with best practices; it is bound by a best-efforts obligation. The Service is provided "as is" and "as available", without any absolute guarantee of availability or absence of error or interruption.
The Seller is not affiliated with, sponsored by, or endorsed by Electronic Arts Inc., the NFL, the NFLPA, or Madden NFL; all trademarks cited belong to their respective holders.
To the extent permitted by applicable law, the Seller's total liability, on any basis, is limited to the amount actually paid by the Customer in the twelve (12) months preceding the event giving rise to the claim. The Seller shall not be liable for indirect damages, nor for the consequences of misuse of the Service or decisions made by the Customer based on the analyses provided.
Article 11 — Force majeure
The Seller shall not be liable for any delay or failure resulting from an event beyond its reasonable control, including: natural disaster, failure of telecommunications networks, unavailability of hosting infrastructure, or a decision by a third party over which the Seller has no control (in particular the restriction or removal of an API or service by Electronic Arts). If such an event persists beyond thirty (30) days, either party may terminate the contract without compensation.
Article 12 — Personal data
Customer data is processed in accordance with the Service's Privacy Policy, which details the purposes, legal bases, retention periods, and the Customer's rights (access, rectification, erasure, portability, objection). Payment data is processed by Paddle under its own privacy policy.
Article 13 — Changes to the Terms of Sale
The Seller reserves the right to modify these ToS at any time, in particular to adapt them to legal or technical developments. The version in force is the one published on this page. In the event of a material change, Customers are informed by email. Changes do not affect ongoing subscriptions, which remain governed by the ToS accepted at the time of subscription until their next renewal.
Article 14 — Severability
If any provision of these ToS is found to be illegal, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not in any way affect the validity or enforceability of the remaining provisions.
Article 15 — Governing law, consumer protections, and jurisdiction
These ToS are governed by the law applicable in French Polynesia. Failing amicable resolution, any dispute shall fall under the exclusive jurisdiction of the courts of Papeete.
However, where the Customer acts as a consumer, no provision hereof shall deprive them of the mandatory protections afforded by the law of their country of habitual residence; such protections remain applicable notwithstanding the governing law and jurisdiction clause above.
The French version of these ToS shall prevail. Any translation is provided for informational purposes only.
